4.1.1 Production -related qualifications and regulations:

5.1 Monitoring Chemicals (primarily used for the production of chemical weapons)

5.1.1 Production License and Qualifications:

The state implements a special permit method for the production of specific organic chemicals containing phosphorus, sulfur, and fluorine in the second and third categories of monitored chemicals, as well as in the fourth category of monitored chemicals. The competent department of the chemical industry under the State Council is responsible for issuing special production permits, and no unit or individual may produce monitored chemicals without a special production permit.

For monitored chemicals that fall within the scope of special production license management and are also included in the production license management by relevant national departments, enterprises should apply for a special production license certificate in accordance with these rules after obtaining the production license. Production can only be carried out after obtaining a special production license.

Facilities that are newly built, expanded, or renovated for the production of specific organic chemicals containing phosphorus, sulfur, and fluorine in Class II, III, and IV monitored chemicals shall submit an application to the competent department of the Chemical Weapons Convention in the province, autonomous region, or municipality directly under the Central Government where they are located, and fill out the "Application Form for New (Modified) or Expanded Monitoring Chemicals" (see Annex 1). After initial review and approval, they shall be submitted to the competent department of the State for the implementation of the Chemical Weapons Convention for approval before project approval and construction procedures can be processed. After the completion of the project and passing the acceptance inspection by the competent department, the special production permit procedures shall be handled in accordance with these detailed rules.

Units and individuals applying for special production licenses should meet the following conditions:

（1） Complete basic information of the enterprise must be provided (as required in the attachment);

（2） Must hold a business license issued by the Administration for Industry and Commerce;

（3） The product quality must meet national standards or industry (ministerial) standards (for products that have not yet formulated national or ministerial standards, enterprise standards shall be temporarily implemented);

（4） Must have standard measuring and testing equipment; （5） There are complete environmental protection facilities, and the "three wastes" emitted must meet the national standards;

（7） Production, storage, sales, and complete ledger with standards;

（8） The approval documents and certificates stipulated in the production license issued by other national management departments, as well as other relevant documents necessary for the production of the variety;

（9） Must have full-time or part-time management personnel familiar with monitoring chemical data statistics and corresponding management systems;

（10） It is necessary to have relevant documents such as standard implementation location maps, process flow sketches, equipment layout diagrams, key equipment lists, production record samples, and product sales record samples required by the national competent authority for the implementation of the Chemical Weapons Convention;

（11） The legal representative of the enterprise must understand the provisions of the Regulations and the Convention on the Prohibition of Chemical Weapons regarding enterprise activities.

5.1.2 Proof required for import and export:

Import：

The designated unit shall submit the following documents when applying:

（1） Original price of valid import contract;

（2） The application report for import provided by the enterprise to the provincial authority in charge of the Chemical Weapons Convention, including the name, quantity, final use, and guarantee of non transit of the chemical, as well as the certification document issued by the provincial authority in charge of the Chemical Weapons Convention;

（3） Import application report of designated unit;

（4） Copy of the import license and customs declaration for the previous batch of similar products, and return the original license that was not imported due to reasons.

The designated unit shall submit the following documents when applying:：

（1） Original price of valid export contract;

（2） A guarantee letter issued by the government or government commissioned agency of the importing country that the imported monitored chemicals are not used for the production of chemical weapons and are not transshipped to third countries, indicating the name, quantity, end use, and the name and address of the end user of the required chemicals;

（3） Foreign customer information (customer name, business scope, address, telephone and fax numbers);

（4） Designated unit export application report;

（5） Copy of export license and customs declaration for the previous batch of similar products, and return the original license that could not be exported due to reasons.

5.1.3 Transportation and Required Qualifications:

The railway, highway, waterway, and air transportation of monitored chemicals shall comply with the regulations on the transportation of dangerous goods issued by the relevant competent departments of the State Council.

5.2 Radioactive materials

5.2.2 Procurement and Required Qualifications:

Nuclear materials must comply with the Regulations on the Administration of Nuclear Materials of the People's Republic of China and obtain permits from both the Nuclear Safety Administration and the National Defense Science and Technology Commission.

5.2.3 Transportation and Required Qualifications:

Relevant valid certificates and transportation manuals, radiation monitoring reports, emergency response guidelines for nuclear and radiation accidents, loading and unloading methods, safety protection guidelines, and approval of nuclear and radiation safety analysis reports for the transportation of radioactive materials.

5.3 Anesthetic and Psychotropic Drugs

5.3.1 Production and certification qualifications:

（6） Have a management level and business scale that is suitable for the safety production requirements of narcotic drugs and psychotropic drugs;

（7） Personnel from the production management and quality management departments of narcotic drugs and psychotropic drugs should be familiar with the management of narcotic drugs and psychotropic drugs, as well as relevant laws and administrative regulations on drug control;

（8） No production or sale of counterfeit or inferior drugs, or violation of relevant laws and administrative regulations on drug control;

（9） Comply with the requirements for the number and layout of designated production enterprises for narcotic drugs and psychotropic drugs announced by the drug regulatory department of the State Council.

5.3.2 Procurement and Required Qualifications:

（1） National and regional wholesale enterprises selling anesthetic drugs and Class I psychotropic drugs to medical institutions shall deliver the drugs to the medical institutions. Medical institutions are not allowed to pick up goods on their own.

（2） Designated wholesale enterprises of Class II psychotropic drugs may sell Class II psychotropic drugs to medical institutions, designated wholesale enterprises, drug retail enterprises that comply with the provisions of Article 31 of these Regulations, and other units approved in accordance with the provisions of these Regulations.

（3） Anesthetic drugs and Class I psychotropic drugs shall not be sold for retail. It is prohibited to use cash for the transaction of narcotic drugs and psychotropic drugs, except for individuals who legally purchase narcotic drugs and psychotropic drugs.

（4） Drug retail chain enterprises that implement unified procurement, distribution, and management can engage in the retail business of Class II psychotropic drugs with the approval of the municipal drug supervision and management department where they are located.

（5） Retail enterprises of Class II psychotropic drugs shall sell Class II psychotropic drugs in prescribed doses based on prescriptions issued by practicing physicians, and keep the prescriptions for 2 years for future reference; Prohibit the sale of Class II psychotropic drugs beyond the prescribed dosage or without a prescription; Do not sell Class II psychotropic drugs to minors.

（6） Anesthetic drugs and psychotropic drugs are priced by the government, and on the basis of setting factory and wholesale prices, a national unified retail price is gradually implemented. The specific measures shall be formulated by the competent pricing department of the State Council.

5.3.3 Transportation and Required Qualifications:

（1） For the consignment, transportation, and self transportation of narcotic drugs and psychotropic drugs, safety measures should be taken to prevent them from being stolen, robbed, or lost during transportation.

（2） For the transportation of narcotic drugs and Class I psychotropic drugs by railway, containers or railway luggage cars shall be used for transportation. The specific measures shall be formulated by the drug supervision and administration department of the State Council in conjunction with the railway competent department of the State Council. If there is no railway that requires the transportation of narcotic drugs and Class I psychotropic drugs by road or waterway, a dedicated person should be responsible for escorting them.

（3） Units that transport or transport narcotic drugs and Class I psychotropic drugs by themselves shall apply to the drug supervision and administration department at the city level where they are located for a transportation certificate. The transportation certificate is valid for one year. The transportation certificate shall be kept by a dedicated person and shall not be altered, transferred, or lent.

（4） The consignor shall deliver a copy of the transportation certificate to the carrier when handling the transportation procedures for narcotic drugs and Class I psychotropic drugs. The carrier shall inspect and store a copy of the transportation certificate, and check the packaging of the goods. If there is no transportation certificate or the packaging of the goods does not comply with regulations, the carrier shall not carry them. The carrier shall carry a copy of the transportation certificate during the transportation process for inspection.

（5） When mailing narcotic drugs and psychotropic drugs, the sender shall submit a certificate of approval for mailing issued by the drug supervision and management department at the city level where the district is located. Postal service institutions shall verify and store the certificate of approval for mailing; Postal service institutions shall not accept or send items without proof of permission for mailing. The postal authorities of provinces, autonomous regions, and municipalities directly under the central government shall designate postal service institutions that meet the safety guarantee conditions to be responsible for receiving and sending narcotic drugs and psychotropic drugs. Postal service institutions shall inspect the received and sent narcotic drugs and psychotropic drugs in accordance with the law. The specific management measures for mailing narcotic drugs and psychotropic drugs shall be formulated by the drug regulatory department of the State Council in conjunction with the competent postal department of the State Council.

（6） When transporting narcotic drugs and Class I psychotropic drugs between designated production enterprises, national wholesale enterprises, and regional wholesale enterprises, the shipper shall submit relevant information about this transportation to the drug supervision and administration department of the provincial, autonomous region, or municipality directly under the Central Government before shipment. 5.4 Non pharmaceutical anesthetics and psychotropic drugs

5.4.1 Classification and management of medicinal and non medicinal categories

Anesthetic drugs and psychotropic drugs are classified and managed according to medicinal and non medicinal categories. 5.4.2 Procurement and Transportation Qualifications

It is prohibited for any unit or individual to produce, buy, sell, transport, use, store, and import/export non pharmaceutical anesthetics and psychotropic drugs under regulation. 5.7.1 Import and export related procedures:

Those who import or export toxic chemicals listed in the above list shall apply to the Ministry of Environmental Protection for the release of toxic chemical import (export) environmental management in accordance with relevant announcements and attachments. Import and export operators shall submit the release notice for environmental management of toxic chemicals for inspection and handle import and export procedures with the customs.
